Terms of Service

Skybrite Skylights are committed to providing quality products and dependable service.

We take pride in supplying genuine skylight spare parts and aim to ensure every customer has a smooth, reliable experience from order to delivery.

Our Returns & Refunds Policy outlines the conditions under which returns, exchanges, or refunds may be approved, so you can purchase with confidence knowing where you stand if something isn’t quite right.

All skylight spare parts supplied by Skybrite Skylights are manufactured to comply with the Australian Skylight Standard AS4285 ensuring safety, performance, and suitability for Australian conditions.

Warranty

The length of the manufacturers warranty commences upon payment of the product. Manufacturers warranties will vary. They are normally guaranteed against any defects for a period of 5 to 7 years.

Who Is Covered

If you live in Australia and you are the original consumer purchaser you are entitled to the benefits of this warranty.

What Is Covered

We warrant that your spare parts are free from any manufacturing defects.

Exclusions

Acts of God

This warranty does not cover any events beyond the control of Skybrite Skylights; such as flooding, earthquakes, bush fires, tropical cyclones, and severe storms carrying gale force winds in excess of 50km/h, causing damage to the skylight or causing leaks to occur. Any damage incurred as a result of these events, is the sole responsibility of the consumer.

Returns Policy

Returns

This policy applies in addition to your rights under the Australian Consumer Law. Nothing in this policy excludes, restricts or modifies any consumer guarantee or other right that cannot legally be excluded.

Change of mind returns

Skybrite may accept change-of-mind returns for standard stocked products where:

  • the return is requested within 30 days of delivery;
  • the product is unused, uninstalled, unmarked and in resalable condition;
  • the product is returned in its original packaging with all components and accessories; and
  • Skybrite has approved the return before the product is sent.

Customers are responsible for the cost and risk of returning change-of-mind items.

Approved change-of-mind returns are subject to a restocking fee equal to 10% of the original product price. Original delivery charges are non-refundable. Any new delivery charges associated with an exchange are also payable by the customer.

Refunds or exchanges will be processed after the returned product has been received and inspected by Skybrite.

Products excluded from change of mind returns

Unless otherwise agreed by Skybrite in writing, change of mind returns are not available for:

  • custom-made or made-to-order products;
  • special-order or custom-sized domes;
  • large custom dome orders;
  • skylight kits;
  • clearance or sale products; or
  • products that have been installed, used, altered, marked or damaged after delivery.

These exclusions do not affect any rights or remedies available under the Australian Consumer Law.

Incorrect, damaged or faulty products

Please contact Skybrite promptly if a product is incorrect, damaged, faulty or does not match its description. We may request photographs, measurements, proof of purchase or other information reasonably required to assess the issue.

Where a product does not comply with the consumer guarantees under the Australian Consumer Law, you may be entitled to a repair, replacement, refund or other remedy, depending on the circumstances and whether the failure is major or minor.

Restocking fees will not apply where a remedy is required under the Australian Consumer Law. Original packaging is not required for an Australian Consumer Law claim, although customers should package returned products appropriately to prevent further damage.

If the product is confirmed to have a problem covered by the Australian Consumer Law, Skybrite will reimburse reasonable return costs or arrange collection where required. Products damaged through misuse, improper installation, unauthorised modification or other actions of the customer may not qualify for a remedy.

Returning a product

Please contact Skybrite before returning any product to obtain approval and the correct return address and instructions. Products must not be returned without prior authorisation.

If an item submitted as a change-of-mind return does not meet the eligibility requirements, Skybrite will contact the customer. The customer may be required to pay the cost of returning the item to them.

Refunds will ordinarily be issued using the original payment method unless otherwise agreed.

Fit Check Guarantee

Skybrite offers a free Fit Check service before dispatch to help customers select a suitable replacement product.

Customers must provide complete and accurate measurements, photographs and other requested information. The Fit Check is based solely on the information supplied and does not cover an incorrect selection resulting from inaccurate or incomplete information, unreported modifications, installation issues or site conditions that cannot be identified from the information provided.

If Skybrite confirms a product through the Fit Check process and the product supplied does not correspond with that confirmation, please contact us so that we can assess the matter and provide an appropriate resolution.

The Fit Check Guarantee does not exclude or limit your rights under the Australian Consumer Law.

Terms and Conditions

Conditions of Sale

All products and services offered for sale by Skybrite Skylights are sold subject to the terms and conditions stated herein. These terms and conditions shall apply to the sale of the products offered by Skybrite Skylights.

Payment

Payment for all skylight spare parts is due on checkout and before dispatch. Visa, MasterCard, Paypal or Direct Transfer are accepted forms of payment. Transfer of ownership to the buyer is completed only once payment is received.

Cancellation of Orders

Special order domes, large custom dome orders and Skylight kit orders can not be cancelled once commenced. If cancellation of a non standard stocked item occurs during the ordering, manufacturing, packaging or delivery of an order, the Customer shall fully reimburse Skybrite Skylights for all costs incurred up to the time of cancellation, a re-stocking fee of 10% of the total of the order and return freight will also be paid for by the customer.

Shipping and Delivery

Shipping

This policy applies in addition to your rights under the Australian Consumer Law. Nothing in this policy excludes, restricts or modifies any right or remedy that cannot legally be excluded.

Delivery estimates

Estimated dispatch and delivery timeframes are provided as a guide only and may vary depending on product availability, destination, order size, carrier capacity and circumstances outside Skybrite’s reasonable control.

Skybrite will take reasonable steps to dispatch orders within the stated timeframe and will notify customers of any material delay that becomes known to us.

Delivery estimates are not guaranteed delivery dates unless Skybrite expressly confirms a date in writing. Customers should not schedule installers or other trades until the goods have been received and checked.

If an order cannot be supplied within the stated timeframe or a reasonable time, Skybrite will work with the customer to provide an appropriate solution in accordance with the Australian Consumer Law.

Delivery address

Customers are responsible for providing a complete and accurate delivery address, postcode, contact name, telephone number and any relevant access instructions.

Please notify Skybrite immediately if any delivery information is incorrect. Address changes cannot always be made after an order has been dispatched.

Where delivery is delayed, redirected or unsuccessful because the customer supplied incorrect or incomplete information, the customer may be responsible for reasonable redelivery or redirection costs. Skybrite will advise the customer of those costs before arranging redelivery where practicable.

Authority to leave

Where a customer provides authority to leave, the customer authorises the carrier to leave the goods at the delivery address without obtaining a signature.

Delivery will generally be considered completed when the carrier leaves the goods at the nominated address in accordance with the customer’s authority-to-leave instructions. The customer accepts the risk of theft, loss or damage occurring after a properly completed authority-to-leave delivery.

Authority to leave does not excuse delivery to an incorrect address or a failure to follow the agreed delivery instructions. Nothing in this section excludes rights available under the Australian Consumer Law.

Tracking and delivery enquiries

Tracking information will be provided where available. Carrier tracking updates are supplied by the carrier and may occasionally be delayed or incorrect.

If tracking records an order as delivered but the customer cannot locate it, the customer should:

  • check the delivery location and any safe places around the property;
  • check with other occupants, neighbours, reception or building management; and
  • contact Skybrite promptly so that we can lodge an enquiry with the carrier.

Skybrite may request information reasonably required to investigate the delivery, including confirmation of the delivery address and authority-to-leave instructions.

The carrier may require time to review driver records, photographs, GPS information or other proof of delivery. Skybrite will remain responsible for managing the enquiry with the carrier and will provide an appropriate remedy if the goods cannot be accounted for within a reasonable time.

Damaged deliveries

Customers should inspect all goods as soon as reasonably possible after delivery.

Visible damage should be reported to Skybrite within 24 hours of delivery where possible. Prompt notification allows us to preserve evidence and pursue the matter with the carrier. A failure to report damage within 24 hours does not automatically exclude any rights available under the Australian Consumer Law.

Customers should retain the goods and packaging and provide photographs of:

  • the damaged product;
  • the internal and external packaging;
  • the shipping label; and
  • any visible damage to the parcel.

Customers must not install or modify a product after discovering damage unless instructed by Skybrite.

Where goods are damaged in transit or otherwise fail to comply with the Australian Consumer Law, Skybrite will provide the remedy required by law. Depending on the circumstances, this may include a repair, replacement, refund or compensation.

Missing items

Customers should check the contents of their order promptly after delivery and notify Skybrite within seven days where possible if an item or component is missing.

The notification should include the order number, details of the missing item and photographs of the goods and packaging where available.

The seven-day notification period assists Skybrite in investigating packing and carrier records but does not exclude rights that may apply under the Australian Consumer Law.

If Skybrite confirms that an item was omitted from the order, we will supply the missing item or provide another appropriate remedy at no additional cost.

Freight charges

Freight charges depend on the size, weight and destination of the order. Orders exceeding 5 kg, orders with a large cubic volume and deliveries to regional or remote locations may incur additional freight charges.

Where the website cannot calculate the complete freight charge at checkout, Skybrite will provide the customer with a freight quotation before dispatch. No additional freight charge will be applied without the customer’s approval.

If the customer does not accept an additional freight charge, the order may be cancelled and amounts paid will be refunded, subject to any separate and clearly disclosed terms applying to custom-made products where production has already commenced.

International Deliveries

International orders may be subject to import duties, taxes and customs clearance fees imposed by the destination country. These charges are not included in our product prices or shipping costs and are the responsibility of the recipient. Charges are determined by local customs authorities and/or carriers and cannot be accurately calculated by Skybrite Skylights in advance. Payment is generally requested by the carrier when the shipment reaches the destination country, during customs clearance or before final delivery.

Delivery access and large items

The customer must advise Skybrite before dispatch of any delivery restrictions, including limited vehicle access, stairs, lifts, gated premises, construction sites or locations requiring specialised unloading equipment.

Unless expressly agreed otherwise, delivery is to the accessible ground-level delivery point nominated by the carrier. Additional services such as hand unloading, tailgate delivery, crane assistance, restricted-access delivery or redelivery may incur additional charges where those services were required because of information not disclosed by the customer.

Any additional charge will be communicated to the customer before the additional service is arranged where practicable.

Risk and ownership

Where Skybrite arranges delivery, risk in the goods passes to the customer when the goods are delivered to the nominated address or left in accordance with the customer’s authority-to-leave instructions.

Where the customer arranges collection by their own carrier or transport provider independently of Skybrite, risk passes to the customer when the goods are collected by that provider, to the extent permitted by law.

Ownership of the goods passes to the customer once Skybrite has received payment in full.

Nothing in this section excludes, restricts or modifies Skybrite’s obligations or the customer’s rights under the Australian Consumer Law.
